Release of Claims & Disclaimer

IMPORTANT: Please read this document carefully before using any services provided by The CREST Collaborative, including Personal HR Advisor services and The Resilience Lab. By engaging with our services, you acknowledge that you have read, understood, and agree to the terms outlined below.
1. Nature of Services
Personal HR Advisor Services
The CREST Collaborative provides personal HR advisory services, coaching, and consultation. These services include but are not limited to:
- Career guidance and professional development coaching
- Workplace relationship navigation
- HR policy and procedure consultation
- Professional communication strategies
- Career transition support
The Resilience Lab
The Resilience Lab is a self-directed web-based tool designed to support personal growth, self-reflection, and resilience-building through journaling, boundary-setting exercises, and values clarification activities.
2. Not Professional Services
The services provided by The CREST Collaborative are NOT:
- Legal services or legal advice: I am not an attorney and do not provide legal advice. Any information provided should not be considered legal counsel. You should consult with a qualified attorney for legal matters.
- Mental health services or therapy: I am not a licensed therapist, psychologist, psychiatrist, or mental health professional. The services provided are not a substitute for professional mental health care, diagnosis, or treatment.
- Medical advice: I do not provide medical advice, diagnosis, or treatment. You should consult with qualified healthcare professionals for any medical or health-related concerns.
- Employment guarantees: While I provide career guidance and job search support, I cannot and do not guarantee any specific employment outcomes.
- Financial or investment advice: Any discussion of compensation or financial topics is informational only and should not be construed as financial planning or investment advice.
3. Client Responsibility
By engaging with The CREST Collaborative services, you acknowledge and agree that:
- You are responsible for your own decisions and actions based on information or guidance provided
- You will seek appropriate professional services (legal, medical, mental health, financial) when needed
- You understand that coaching and advisory services involve collaboration, and outcomes depend significantly on your own efforts and circumstances
- You are mentally and emotionally capable of participating in coaching conversations and self-reflection exercises
- If you are experiencing a mental health crisis, you will immediately contact appropriate emergency services or mental health professionals
4. Mental Health & Crisis Resources
If you are experiencing a mental health emergency, please contact:

- Your mental health provider or therapist
The CREST Collaborative services are not equipped to handle mental health crises or emergencies.
5. Confidentiality & Privacy
While I maintain confidentiality of our conversations to the best of my ability, you understand that:
- I am not bound by the same confidentiality requirements as licensed therapists or attorneys
- I may be required to disclose information if legally compelled to do so
- I will maintain confidentiality except where disclosure is required by law or necessary to prevent harm
The Resilience Lab Data Privacy
As stated in our Privacy Policy, all data entered into The Resilience Lab is stored locally on your device. We do not collect, access, or store any of your personal information. You are responsible for the security of your device and any backups you create.
6. Limitation of Liability
To the fullest extent permitted by law, The CREST Collaborative and Andrea Seitz shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from:
- Your use of or inability to use our services
- Any decisions or actions you take based on information or guidance provided
- Any employment outcomes or career transitions
- Any interactions with your employer, colleagues, or other third parties
- Technical issues with The Resilience Lab web application
- Loss of data from The Resilience Lab due to browser clearing, device changes, or technical failures
7. No Guarantees or Warranties
The CREST Collaborative makes no guarantees or warranties regarding:
- Specific outcomes or results from our services
- Employment, promotion, or career advancement
- Resolution of workplace conflicts or challenges
- Improvement in personal or professional circumstances
- Availability or functionality of The Resilience Lab web application
All services are provided "as is" without warranties of any kind, express or implied.
8. Independent Judgment
You acknowledge that:
- You will exercise your own independent judgment in all matters
- Information provided is based on general principles and may not apply to your specific situation
- You are encouraged to seek multiple perspectives and professional opinions
- The final decision on any action is solely your responsibility
9. Release of Claims
By engaging with The CREST Collaborative services, you hereby release, waive, and forever discharge The CREST Collaborative, Andrea Seitz, and any affiliated parties from any and all claims, demands, damages, actions, causes of action, or suits of any kind arising from or related to:
- The provision of coaching, advisory, or consultation services
- Your use of The Resilience Lab web application
- Any information, guidance, or recommendations provided
- Your employment status, career decisions, or workplace relationships
- Any outcomes or consequences resulting from our engagement
10. Termination of Services
Either party may terminate the advisory relationship at any time. The CREST Collaborative reserves the right to discontinue services if:
- You require services beyond the scope of what is offered (e.g., legal, medical, or mental health services)
- The working relationship is no longer productive or appropriate
- There are concerns about your safety or the safety of others
11. Indemnification
You agree to indemnify and hold harmless The CREST Collaborative and Andrea Seitz from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use of our services
- Your violation of this agreement
- Your violation of any rights of another party
- Actions you take based on information or guidance provided
12. Governing Law
This Release of Claims and Disclaimer shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.
13. Severability
If any provision of this document is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remainder of this document shall remain in full force and effect.
14. Entire Agreement
This Release of Claims and Disclaimer, together with the Privacy Policy, constitutes the entire agreement between you and The CREST Collaborative regarding the services provided.
15. Changes to This Document
The CREST Collaborative reserves the right to modify this Release of Claims and Disclaimer at any time. Changes will be posted with an updated "Last Updated" date. Your continued use of our services after such changes constitutes your acceptance of the new terms.
Acknowledgment of Understanding
By signing below (or by engaging with The CREST Collaborative services), I acknowledge that:
- I have read and understand this entire Release of Claims and Disclaimer
- I have had the opportunity to ask questions and seek independent legal counsel if desired
- I understand the nature and limitations of the services provided
- I understand that The CREST Collaborative does not provide legal, medical, or mental health services
- I agree to the terms and conditions outlined in this document
- I am entering into this agreement voluntarily and of my own free will
